KOTA KINABALU (Jan 7): A director of a company was freed by the Sessions Court here today from two charges of committing criminal breach of trust (CBT).
Judge Elsie Primus acquitted and discharged Wong Kim Hing, 53, after ruling the defence had succeeded in casting reasonable doubt on the prosecution’s case.
On the first count, Wong was accused of embezzling company funds amounting to RM1,507,574.80 between April 28 and Dec 29, 2021.
On the second count, he was charged with committing CBT involving RM200,669 between July 22 and Sept 12, 2022.
The charges were framed under Section 409 of the Penal Code, which provides for up to 20 years’ imprisonment and whipping or a fine, upon conviction.
Seven prosecution witnesses were called to testify against Wong, while the defence produced four witnesses, including Wong.
Wong was represented by counsels Datuk Ram Singh and Prem Elmer Ganasan.
