KUCHING (Feb 6): The Sessions Court here on Friday sentenced a duo to 15 years’ imprisonment each, for the gang rape of a 14-year-old girl last month.
Azrin Dollah, 21, and Tajudin Mohd Kamri, 35, were both convicted by Judge Jason Juga, on their guilty plea to a charge under Section 375B of the Penal Code which carries a maximum 20 years jail term and whipping upon conviction.
The offence was committed at an inn on Jalan Sekama at about 4.30am on January 30.
According to the facts of the case, the victims, aged 16 and 14, went out with a female acquaintance to Pangkalan Sapi, where they met Azrin, whom the 16-year-old had met on several previous occasions, and Tajudin, her “adoptive brother.” During this time, the acquaintance remained in the car.
At around 3am, both accused left Pangkalan Sapi. The female acquaintance drove the victims to Kuching Waterfront before leaving angrily, after the 16-year-old asked her to go and called Azrin to take the two victims home.
Azrin and Tajudin then picked up the victims and brought them to an inn on Jalan Sekama, where Tajudin booked a room in his name with two double beds.
Upon entering the room, Tajudin pulled the 14-year-old onto the bed with him, despite her resistance, which was supported by the 16-year-old. Fearing for the younger girl’s safety, the 16-year-old accompanied to sleep with her on the floor.
When the 14-year-old was asleep, Tajudin cradled her onto the bed and raped her. At the same time, Azrin who at this point gotten sexually aroused, raped the 16-year-old, ejaculating onto her abdomen.
After the incident, the 16-year-old went to wash herself. She then pretended to be asleep, but when she opened her eyes slightly to peep, she saw both accused raping the 14-year-old again while she was still fast asleep, taking turns to penetrate her.
Following this, the 16-year-old reported the incident to the father of the 14-year-old. The father then lodged a police report, which led to the arrest of both accused on Feb 3.
The hotel’s check-ins and check-outs were recorded by closed-circuit television (CCTV).
An Obstetrics and Gynaecology specialist also confirmed that the 14-year-old victim had sustained a linear abrasion to her posterior fourchette at the 5 o’clock position, indicating partial fresh trauma.
In separate proceedings, Tajudin was also sentenced to a further 15 years’ imprisonment and six strokes of the cane by Sessions Court Judge Noorhisham Mohd Jaafar, with the sentence to run concurrently, under Section 376(2)(c) of the Penal Code.
Meanwhile, Azrin was sentenced by Sessions Court Judge Iris Awen Jon to 12 years’ imprisonment, to run concurrently, and four strokes of the cane under Section 376(1) of the same Code.
Iris also ordered Azrin to pay RM3,000 in compensation to the 16-year-old victim, in default six months’ imprisonment.
Deputy public prosecutors Chuah Kai Sheng, Adriana Maisarah Mohd Farid, and Ruvinasini Pandian prosecuted separately, while both accused were unrepresented.
