Cake seller jailed 39 years for raping disabled step-sister

KUCHING, June 10: A 22-year-old cake seller was sentenced today to 39 years in prison and 11 strokes of the cane after pleading guilty to raping his 13-year-old intellectually disabled step-sister on three separate occasions.

The Sessions Court heard that the offender claimed he was influenced by pornography before committing the assaults.

The accused pleaded guilty to three charges under Section 376(2)(k) of the Penal Code. Each conviction carries a penalty of between 10 and 30 years in prison, along with mandatory whipping.

All three incidents took place at a village house in Balai Ringin, Serian, while the teenager’s parents were away from home.

The first assault occurred around 11.30pm in August 2025, the second at 10pm in September 2025, and the third at approximately 6pm in January 2026.

Court documents revealed that during the first two attacks, the man stripped the victim while she was sleeping and forced himself on her despite her crying and struggling. In the third incident, he cornered the victim and ordered her to undress before raping her.

The abuse came to light after Serian Hospital reported that the 13-year-old girl was 33 weeks pregnant.

During an interview with a child protection officer from the Social Welfare Department, the victim identified her step-brother as her attacker.

Police arrested the accused the same day at approximately 5.10pm.

A gynecological examination later confirmed the abuse. The victim, who holds a person with disabilities (OKU) card, is currently eight months pregnant.

Deputy Public Prosecutor Chuah Kai Sheng pushed for a severe penalty, emphasising the severe psychological trauma and physical harm inflicted on the vulnerable victim. He also requested that the prison terms run consecutively, as the crimes were committed on separate dates.

Judge Iris Awen Jon sentenced the man to 13 years and four strokes of the cane for the first charge, 13 years and three strokes for the second, and 13 years and four strokes for the third. Ordering the sentences to run consecutively, the judge handed down a total jail term of 39 years.

The court also ordered the offender to undergo rehabilitation counseling while in custody and to be placed under police supervision for two years upon his release.
